O R D E R

The petitioner has filed this writ petition, to issue a Writ of Mandamus, directing the 1st respondent to pass an order and conduct an enquiry based on the the petitioner's application dated 13.08.2018, on giving due opportunity to the petitioner and delete the names of 3rd respondent's deceased father Nadhappa Udaiyar and respondents 4 to 6 which was illegally mutated in Patta No.1020 and restore the original joint patta in the name of Marimuthu Udayar and Muhammud Ansari.

2. However, during the pendency of this writ petition, the Revenue Tahsildar, Virudhachalam, the 2nd respondent herein, has sent a letter dated 10.09.2025 to the Revenue Divisional Officer, Virudhachalam, the 1st respondent herein, stating that for the very same issue, a suit in O.S No.307 of 2018 is pending on the file of the Principal Subordinate Court, Virudhachalam

and based on the decree passed by the said Principal Subordinate Court, Virudhachalam, they will take steps to delete the names in the patta.

3. In view of the said communication, the prayer sought for by the petitioner has become infructuous. However, liberty is granted to the petitioner and the private respondents to canvas all those points in O.S No.307 of 2018 pending on the file of the Principal Subordinate Court, Viurdhachalam. The succeeding parties is granted liberty to make a fresh application before the 2nd respondent for mutation of the records.

4. In view of the above, this writ petitions stands disposed of . No costs.
