Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to conduct fresh written test for the post of Senikor Factory Assistant pursuant to the advertisement 5207/2017-1 dated 13.9.2017.

O R D E R

The relief sought for in the present writ petition is for a direction to direct the respondent to conduct fresh written test for the post of Senior Factory Assistant pursuant to the advertisement dated 13.9.2017.

2. The respondent is a Co-operative Society registered under the provisions of the Tamil Nadu Co-operative Societies Act, 1983. Thus, the writ petition is not maintainable in view of the judgment of the larger Bench of this Court in the case of K.Marappan vs. Deputy Registrar of Co-Operative Societies, Namakkal Circle, Namakkal [(2006) 4 CTC 689 (FB)].

3. The writ petitioner has to exhaust the statutory remedy provided under the Tamil Nadu Co-operative Societies Act, 1983, more specifically, Section 153 of the Act provides revision and the writ petitioner has to approach the competent authorities by filing an appropriate petition for the redressal of his remedy.

4. Accordingly, the Writ Petition stands dismissed as not maintainable. However, there shall be no order as to costs.
