The applicant herein filed the suit against the respondent complaining infringement of design and passing off.

2. In the affidavit filed in support of this application it is stated by the applicant that the applicant is carrying on business at Chennai. It is also stated that the respondent's infringing goods are delivered and available in Chennai, within the territorial limits of this Court. Hence, part of cause of action arose within the territorial limits of this Court.

3. It is also stated that the promotion materials in respect of the respondent's products are available in youtube.com, which is accessible to the customers from Chennai.

4. In view of the said assertion made by the applicant, this Court is inclined to allow the leave petition. Accordingly, the Application in A.No. 3088 of 2023 is allowed.
