Petition filed under Article 226 of the Constitution of India for the issuance of writ of mandamus, directing the third respondent to pay subsistence allowance for the period of suspension from 11.08.2014 payable to the petitioner and to conclude the enquiry in respect of allegation alleged against him. O R D E R

The petitioner was placed under suspension by order dated 11.08.2014. Since the third respondent failed to pay him subsistence allowance, the petitioner is before this Court.

2. The learned Standing Counsel for Tamilnadu State Marketing Corporation Limited on instructions submitted that disciplinary proceedings initiated against the petitioner would be disposed of within a period of three months.

3. The third respondent is directed to dispose of the disciplinary proceedings pending against the petitioner as expeditiously as possible and in any case within a period of three months from the date of receipt of a copy of this order.

4. The third respondent is further directed to pay subsistence allowance to the petitioner in accordance with Rules. The arrears of subsistence allowance commencing from January 2015 should be paid within a period of two weeks from the date of receipt of a copy of this order.

5. The writ petition is disposed of with the above direction. No costs.
