J.

The petitioners who apprehends arrest at the hands of the respondent police for the alleged offences under Section 420 IPC in Crime No.228 of 2023, on the file of the respondent police, seek anticipatory bail.

2. Learned counsel for the petitioners submitted that petitioners are implicated as accused in Crime No.228 of 2023, registered for the alleged offences under Section 420 IPC. FIR allegations, the alleged money transaction made by the defacto complainant and others, are not supported by any material evidence. First petitioner is a woman and has small children and thus, prayed for anticipatory bail for the petitioners.

3. In response, the learned Government Advocate (Crl.Side) submitted that petitioners along with other accused have cheated the defacto complainant and his friends to the tune of Rs.59,00,000/-. Investigation in this case is at preliminary stage. Petitioners are also

accused in EOW No.19 of 2013 - Tiruppur, EOW No.1 of 2018 - Trichy, Crime No.596 of 2016 - Tiruppur and Crime No.159 of 2009 - Raichur City, Karnataka. Thus, he prayed for dismissal of this petition. 4.Considered the rival submissions and perused the records. 5.FIR allegations in brief show that first accused had approached the defacto complainant with a business proposal, wherein, he said that they are going to start WELTEX showroom throughout Tamil Nadu. For starting one showroom, defacto complainant has to pay Rs.15,00,000/- and the interior work would be taken care of by them and defacto complainant would get profit of 30% from the business. Believing his words, defacto complainant and others said to have transferred a total sum of Rs.59,25,000/-. When the business proposal was not fructified and defacto complainant demanded the amount paid, it is stated that the accused had made criminal intimidation and death threat. The specific allegation against the first petitioner is that she is said to have threatened the defacto complainant that if the defacto

complainant comes again seeking money, she would give a rape case against him.

6.Considering the nature and seriousness of the allegations made against the petitioners and other accused and the amount alleged to have been cheated and fact that other criminal cases are pending against the petitioners and the co-accused, this Court is not inclined to grant anticipatory bail to the petitioners.

7.Accordingly, this Criminal Original Petition is dismissed. 04.07.2023 sli
