Application praying that this Hon'ble Court be pleased to pass an order directing the Respondent herein to furnish security for the suit claim of Rs.2,57,91,660/- (Rupees Two Crores Fifty Seven Lakhs Ninety One Thousand Six Hundred and Sixty Only) and for costs of the present suit, failing, which Order Attachment before Judgment of the Respondent's immovable property, namely, land measuring Two Acres and Fifty One Cents in Survey Nos.7 (part), 8 (part) and 37/1, all in Ayanambakkam Village, Ambattur Taluk, Thiruvallur District, together with buildings and machineries thereon, more fully described in the Schedule herein, by transmitting the copy of the Order to the District Munsiff's Court, Ambattur, by issue of precept. By an order dated 28.10.2014, the respondent was directed to furnish security. Despite such order, no security was furnished. A counter affidavit was filed stating that the company was before the Board of Industrial and Financial Reconstruction (BIFR).

2. Thereafter, the matter was referred to mediation. The mediation has also failed.

3. Despite lapse of almost 5 years from the date of the order directing to furnish security, the respondent company has not chosen to furnish security. Hence, there will be an order of attachment of the property mentioned in the schedule hereunder.
