ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 379 and 430 of IPC and Section 21(1) of Mines and Minerals (Development and Regulation) Act 1957 in Crime No.87 of 2021, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused persons have illegally transported 10 units of river sand by using two different Lorries, each carrying 5 units of river sand.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent persons and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate would submit that this is the third anticipatory bail application filed by the petitioner and this Court has already dismissed the earlier anticipatory bail applications of the petitioner. accused persons were involved in illegal transportation of 10 units of river sand by using two different lorries. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner. 5.Considering the gravity of offence and the earlier anticipatory bail petitions were dismissed by this Court and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
