Respondents Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus against the 1st respondent, pertaining to the settlement deed dated 05.09.2007 executed by the petitioner in favour of the respondents 2 to 4 which has been registered as Doc.No.10521 of 2007 on the file of the 5th respondent, directing him to consider the representation letter dated 07.02.2025 sent by the petitioner to the 1st respondent which was duly delivered on 10.02.2025, and declare the settlement deed dated 05.09.2007 executed by the petitioner in favour of the respondents 2 to 4 which has been

registered as Doc.No.10521 of 2007 on the file of the 5th respondent as null and void under Section 23(1) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 within a stipulated time considering the age of the petitioner who is 81 years old.

ORDER

The petitioner is a senior citizen. She executed a settlement deed on 05.09.2007 in favour of her daughters.

2. She pleads that invoking the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, she approached the 1st respondent to pass an order cancelling the settlement deed executed by her in favour of her daughters, who are respondents 2 to 4 herein. As no further action has been taken thereof, she has come forward with the present writ petition.

3. Heard Ms.Sumathi Lokesh for the petitioner and Mr.U.Baranidharan for the 1st respondent.

4. Mr.U.Baranidharan, on instructions from the 1st respondent, states that the representation of the petitioner was considered and the 1st respondent has initiated proceedings and has fixed the hearing on 29.04.2025. On that date, as the private respondents did not appear, the matter has been adjourned sine die.

5. As the proceedings have already been initiated by the 1st respondent, he shall proceed further and complete the entire enquiry within a period of eight weeks from the date of receipt of a copy of this order. In case, the respondents 2 to 4 do not appear before the 1st respondent, the 1st respondent is at liberty to conduct the enquiry in their absence after ensuring that notice have been served and proceed further to pass appropriate orders within the time fixed by this court.
