ORDER

The petitioner, who apprehends arrest at the hands of the respondent for the offences punishable under Section 104 of Customs Act r/w Section 1 / 4

135 & 135(A) of Customs Act in RR.No.1 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner alleged to have illegally transported M-sand and red sand in a lorry and the driver was arrested and based on his confession, the other accused were arrested. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has received a summon dated 07.05.2025 issued under Section 108 of the Customs Act, 1962, in connection with File No.DRI/CZU/VIII/48/ENQ-01/INT-23/2024 and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioner has indulged in illegal transportation of M-sand and red sand and the driver of the lorry was arrested. He further submitted that investigation is conducted and RR Number was assigned as RR.No.1 of 2025. Therefore, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and taking note of the fact that the petitioner is challenging the issuance of summons and a case is also registered by the respondent in File No.RR.No.1 of 2025, the petitioner is directed to appear before the respondent police and cooperate for the investigation and the respondent police is directed not to harass the petitioner and proceed with the investigation.
