Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus directing the 1st Respondent, namely, the Tahsildar of Pochampalli Taluk Office Pochampalli, Krishnagiri District to consider the Petitions of the petitioner dated 14.10.2014 and 19.12.2014 and to take necessary action on the said petitions for cancelling patta No.792 relating to S.No.204B/1F Kanandahalli Village, Pochampalli Taluk, Krishnagiri District and to grant patta in favour of the petitioner.

ORDER

Heard Mr.V.Nicholas, learned counsel for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader appearing for the respondents and with their consent, the writ petition itself is taken up for disposal at the admission stage.

2. Since the writ petition is disposed of at the admission stage without notice to the second respondent, the merits of the allegation made by the petitioner as against the second respondent in his representations dated 14.10.2014 and https://hcservices.ecourts.gov.in/hcservices/

19.12.2014 are not gone into and it is left open to the first respondent to consider the same on merits and in accordance with law.

3. The petitioner in the said representations seeks for cancellation of patta issued in favour of the second respondent and the applications dated 14.10.2014 and 19.12.2014 are pending before the first respondent.

4. In the light of the above, without going into the merits of the allegations made by the petitioner against the second respondent, there will be a direction to the first respondent to consider the representations/petitions dated 14.10.2014 and 19.12.2014, after issuing notice to the petitioner as well as the second respondent and pass orders on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order, if there is no other legal impediment.

5. The writ petition is disposed of with the above direction. No costs.
