The petitioner, who apprehends arrest for the alleged offences punishable under Sections 323, 307, 389, 506(2) and 120(b) IPC in Crime No.108 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. Learned counsel for the petitioner submitted that they wanted to cancel the bail granted to the petitioner on 03.06.2024, stating that, after grant of bail, the 1st respondent/A5 attempted to threaten and also made forceable steps to enter into compromise with the petitioner. The petitioner/defacto complainant gave a complaint, however, the respondent police has not taken the same on file. Thereafter, he submitted that, the 1st respondent conspired with other accused and attempted to tamper the evidence. He further pointed out that, one of the accused namely A7 after coming out of bail, gave an open statement in the presence of reporters that he would do some threatening activities. That video was perused by this Court, in which 1st respondent/A5 has not participated in the meeting. Further more, as on date, he complied with the conditions imposed by this Court. However,

no prima-facie proof, on the side of the petitioner that he was made to threaten specifically by this 1st respondent is produced before this Court. However, defacto complainant is under fear that after the bail, 1st respondent along with other accused would cause any interference to them. But already several conditions have been imposed, not to have any communication with the defacto complainant through any mode. Apprehension of the petitioner is also taken into consideration. However, considering the fact that 1st respondent complied with the conditions, this Criminal Original Petition is dismissed.

3.1st respondent is specifically directed to comply the conditions imposed by this Court and directed not to make any forceable steps to compromise with the petitioner except the Court of law.

4.With the above conditions, this Criminal Original Petition is dismissed. 01.07.2024 gd
