O R D E R

The petitioner seeks a Writ of Mandamus directing the respondents to appoint her to the post of Post Graduate Assistant (Zoology) by taking into consideration her degrees in B.Sc., (Zoology), B.Ed., M.Sc.(Zoology) and without rejecting her candidature on the ground that she took the degree simultaneously in the very same academic year.

2. The second respondent filed a counter affidavit, wherein it was stated that the name of the petitioner has already been forwarded to the Director of School Education. Paragraph No.13 of the counter reads thus:

"13. It is submitted that in view of the decision taken by the Board, the writ petitioner A.Devi was provisionally included in the list for the post of P.G.Assistant in Zoology. Since she secured eligible cut off marks in the MBC communal turn, her name was forwarded to the Directorate of School Education Department to decide on the eligibility of the petitioner on verification of original records."

3. The third respondent is directed to proceed further pursuant to the recommendation made by the second respondent as indicated above.

4. The Writ Petition is disposed of with the above direction. No costs. The connected Miscellaneous Petition is closed. Sd/- Asst. Registrar.
