C.M.P.No.19692 of 2022 in S.A.SR.No.74264 of 2022 P.T.ASHA, J., This petition is filed to condone the delay of 12 days in preferring the instant second appeal.

2. The private notice which has been sent to the respondent's last known address has been returned with the endorsement "unclaimed". The postal endorsement would indicate that intimation has been delivered thrice to the addressee. Therefore, there is a deemed service on the respondent.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 12 days in preferring the instant second appeal is condoned.

4. The Registry is directed to number the appeal, if it is otherwise in order and list the same for admission.
