This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 09.06.2024, seeking bail in Crime No.207 of 2024 for the alleged offences punishable under Sections 147, 148, 447, 294(b), 506 (ii) & 307 of IPC and Section 3 of Tamil Nadu Public Property (Prevention of Damage and Loss) Act.

2. Learned counsel appearing for the petitioner submitted that the petitioner, aged about 50 years is an innocent person and he has been falsely implicated in this case. He further submitted that due to the previous enmity, a false complaint has been given against him and thereby, he has been in custody from 09.06.2024. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that due to the previous enmity, the petitioner along with his henchmen, trespassed into the land of the de facto complainant and cut down the trees (chemmaram) planted in her land and also threatened her with dire consequences. He also submitted that the investigation in this case is still pending and the value of the damaged properties is about Rs.2 lakhs. T.V.THAMILSELVI,J.

4. Heard the learned counsel for the petitioners and the learned Government Advocate (Criminal Side) appearing for the respondent and perused the materials available on record.

5. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) and taking note of the fact that the investigation is still pending and also considering the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner.
