Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari to call for the records related to the order dated 19.07.2001 made in D.R.No.3/2000 E2, by the 1st respondent and to quash the same as illegal and unsustainable. For Petitioner :

This writ petition has been filed challenging the proceedings of the 1st respondent dated 19.07.2001.
2.Heard the learned counsel for the petitioner and the learned Additional Government Pleader for respondents 1 to 3. 3.The petitioner is admittedly a subsequent purchaser of the subject property. The actual dispute was between the original owner and the lessees, who were claiming right as a cultivating tenant in the property. Admittedly, there are civil disputes that are pending between the parties. The petitioner while purchasing the property, has also purchased a litigation. The right of the lessee to continue to be in 2/4
possession and enjoyment of the property cannot be a subject matter of a writ petition. The authorities have considered the same and admittedly, the petitioner was not even a party in this proceedings. 4.In view of the above, this Court does not find any grounds to interfere with the proceedings of the 1st respondent dated 19.07.2001. If at all the petitioner has any other independent right, it is left open to the petitioner to work out the remedy in the manner known to law before the appropriate forum.
5.In the result, this Writ Petition is disposed of in the above terms. Consequently, the connected Miscellaneous Petition is closed. No costs. 10.03.2025 krk Index : Yes / No Internet : Yes / No : Yes / No 3/4
