Petition filed under Article 226 of the Constitution of India for the issuance of writ of Certiorarified Mandamus calling for the records of the respondent in connection with the impugned charge memo issued by him in Memo R. No. 511/A2/2009 dated 13.5.2011 and quash the same and further direct the respondent to promote the petitioner as Motor Vehicle Inspector (Non-Technical) at par with his junior and grant him all consequential service and monetary benefits. O R D E R

The disciplinary authority issued charge memo to the petitioner on 13.5.2011. Thereafter, the enquiry officer conducted enquiry and submitted a report to the disciplinary authority. The petitioner now seeks a direction to the disciplinary authority to conclude the proceedings as expeditiously as possible.

2. The Deputy Transport Commissioner Erode filed a counter affidavit wherein it was indicated that the enquiry officer concluded the enquiry on 3.3.2015 and report was sent to the Head of Department on 10.03.2015. be passed by the disciplinary authority by following the procedure under Tamil Nadu Civil Services (Discipline and Appeal) Rules.

3. The learned senior counsel for the petitioner submitted that the Transport Commissioner is the disciplinary authority insofar as the petitioner is concerned.

4. The disciplinary authority is directed to conclude the proceedings initiated against the petitioner as expeditiously as possible and in any case, within a period of three months from the date of receipt of a copy of this order.
