, Advocate for the petitioner and of MR.K.PRABAKAR Additional Public Prosecutor on behalf of the Respondent the court made the following order:- The above petition is filed seeking to relax the condition imposed by this Court on the petitioner/appellant vide order dated 16.02.2017 made in Crl.MP.No.2361/2017 in Crl.A.No.81/2017. This Court, in its order dated 16.02.2017, had suspended the sentence imposed on the petitioner with a direction to report before the Trial Court at 10.30 a.m., on the first working day of every English Calendar Month until further orders. The learned counsel for the petitioner would submit that the petitioner is a Senior Citizen, aged about 65 years and that he had undergone bypass surgery on 08.05.

2019 and would seek that the condition of appearing before the Trial Court on the first working day of every month, be modified.

Heard the learned Additional Public Prosecutor and perused the affidavit filed in support of the miscellaneous petition. Taking into consideration the health condition and the age of the petitioner, the condition imposed vide order dated 16.02.2017, is hereby modified and the petitioner shall appear before the Trial Court once in four months commencing from the first working day of October 2019 pending Appeal.

The petition is ordered accordingly.
