O R D E R

The petitioner is the plaintiff. He filed a suit for partition in O.S.No.135 of 2018 before the Sub-Court, Hosur, Krishnagiri District against the defendants/respondents. Thereafter, due to the intervention

of the mediation, he filed a memo for withdrawing the suit. However, the Court has directed him to file a petition for withdrawal of the same under Order 23 Rule 1 of CPC. Pursuant to the aforesaid direction issued by the trial Court, the petitioner filed an Interlocutory Application to withdraw the suit on 27.03.2019. But, it appears that the trial Court has not taken the application filed by the petitioner on file. Aggrieved over the action of the trial Court, the petitioner is before this Court.

2. Considering the facts and circumstances of the case, the trial Court is directed to pass orders on the Interlocutory Application filed by the petitioner under Order 23 Rule 1 of CPC in R.O.C.No.2710 of 2019 within a period of two weeks from the date of receipt of a copy of this order.
