2. The learned counsel for the petitioners submitted that the 1st appellant passed away and his legal heirs were already on record as appellant Nos.2 and 3 and to record the same, this application has been filed.

3. Recording the same, since the legal heirs of the 1st appellant were already on record at appellants 2 and 3, they are permitted to continue the appeal.

4. This application is ordered as prayed for. The Registry is directed to make necessary amendment in the cause title after incorporating the death of the 1st appellant.

5. Post the Second Appeal on 24.01.2023.
