O R D E R

This petition is filed seeking direction to the respondent to register petitioner's complaint dated 15.07.2021 in C.S.R.No.not known of 2021 pending on the file of respondent and pass orders.

It is submitted by the learned counsel for the petitioner that petitioner is a resident of Theni and he preferred complaint against the Ex-Deputy Chief Minister, for the past number of years regarding the illegal sand mining done by him and his associates by misusing and abusing their official power and causing damages to the nature by extracting sand mining, Government land, forest land, small mountain in Theni District. Other details in the petition are unnecessary for disposal of this petition, in view of the status report filed by the respondent.

It is seen from the status report filed that primafacie case was made out against the officials of Geology and Mining Department and Revenue Officials and also against the Private Individual Tr.Annaprakash. Approval to register a https://hcservices.ecourts.gov.in/hcservices/

regular case against the officials who served as Assistant Director, Geology and Mining District was received from the Additional Chief Secretary to Government, Industries Department, Chennai on 02.02.2022.

As per the memorandum in VR.No.40938/2021/G&M/TN dated 04.02.2022 of the Director, Vigilance and Anti Corruption Chennai, a case in Theni Vigilance and Anti Corruption Crime No.02/2022 under Sections 120B, 167, 379, 409 of IPC and 7,13(1)(c), 13(1)(d)(i),13(1)(a) r/w 13(2) and 12 of the Prevention of Corruption Act, 1988 against the accused officers 1 to 5 and accused No.12 and under Section 167, 465, 468, 471, 477A r/w 109 of IPC and 7,8(1), 13(1)(a) r/w 13

(2) and 12 of the Prevention of Corruption Act, 1988 as amended by the PC (Amendment) Act, 2018 against the accused Officer 6 to 11 and accused No.12 was registered on 05.02.2022. 4.

It is also submitted that cases in Theni District Crime Branch, Crime Nos.16/2021, 17/2021 & 18/2021 under Sections 409, 465, 466, 468, 471, 472, 477(A) IPC r/w 109 IPC and 13(2) r/w 13(1)(c), 13(1)(d) of Prevention of Corruption Act, and 13(2) r/w 13(1)(a) of Prevention of Corruption (Amendment) Act, 2018 were already registered against the Revenue Officials who served in Theni District in various designations for the allegations levelled against them including the allegations levelled against them by the petitioner herein. The said cases are being investigated as per the order of the Director General of Police/Head of Police Force, Tamil Nadu, in Rc.No.008290/Crime-3(1)/2021, dated 28.12.2021. 5.

It is seen from the status report filed that already FIR has been registered in this case on the allegations made by the petitioner. Therefore, nothing survives in this petition and this criminal original petition is closed.
