(The case has been heard through video conference) This petition has been filed to modify the condition imposed on the petitioner by this Court by order dated 31.10.2017 in Crl.M.P.No.13461 of 2017 in Crl.A.No.852 of 2016 that the petitioner shall report before the trial Court on the first working day of every month.

The learned Counsel for the petitioner would submit that the the petitioner had been complying with the conditions regularly. However, during the month of November 2020, the petitioner's aunt (Mother's sister) fell ill. Since, there was no one to help her, the petitioner had taken her to Adiparasakthi Medical College Hospital, Melmaruvathur and after leaving her with another relative, the petitioner could the reach the Court only in the afternoon. the Court Officer had informed that the timing was over and he could not appear. Hence, he prays that the condition to report before the trial Court on the first working day of every month may be modified.
3. Heard the learned Special public Prosecutor appearing for the respondent police.

In view of the above submission, the condition imposed on the petitioner by order dated 31.10.2017 in Crl.M.P.No.13461 of 2017 in Crl.A.No.852 of 2016 is modified to the effect that the petitioner shall report before the trial Court on the first working day, once in two months at 10.30 a.m. starting from February 2021, until further orders.
