(C.S.R.No.274 of 2021) ....Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the Superintendent of Police, Chengalpattu District to instruct the Sub-Inspector of Police, Orathy Police Station, Madurantakam Taluk, Chengalpattu District to register a case on the complaint of the petitioner dated 10.08.2021 and deal with the accused mentioned in the complaint according to law.

ORDER

(This case has been heard through video conference) The contention of the petitioner is that he has purchased the property in the year 1984 and from there, he was residing in the property. On 09.08.2021 at about 04.00 p.m., several persons claiming to be ruling party taking the law into their hands have removed the thatched shed and also assaulted the petitioner. Hence, the petitioner lodged a complaint on 10.08.2021, but no action taken.

2. The learned Government Advocate (Crl. Side) appearing for respondents would submit that in this case, the petitioner had not produced any document to prove that he is the original owner and also residing in the property even by adverse possession. Further, the revenue authorities also inspected the records and found to be the Government Grama natham land. The petitioner put up a thatched shed encroaching the property and claiming right over the property. The petitioner's contention that he is residing from 1984, which is not in dispute, but, no document was produced by him.

3. In view of the same, this Court directs the petitioner to make a representation along with other revenue records before the 2nd respondent police, thereafter, the respondent police to take appropriate action and dispose the complaint of the petitioner.

4.With the above direction, this Criminal Original Petition is disposed of.
