The relief sought for in this writ petition is for a direction to direct the respondent to appoint the petitioner for the post of Noon Meal Organiser in Kallarpalayam Village, Thiruvannamalai District.
2. The petitioner claims that she is the resident of the above said Kalarpalayam Village, Tiruvannamalai Taluk, Tiruvannamalai District, and studied up to 9th standard (Tamil Medium) and accordingly, she is eligibile for appointment to the post of Noon Meal Organiser. The petitioner states that she has applied for the post of Noon Meal Organiser and the second respondent in letter No.310/10 dated 10.12.2010 called upon the petitioner to appear and participate in the interview to be conducted on 15.12.2010 at about 10.00 in the second respondent office.
3. Further, the interview cards were sent to other candidates and the petitioner as per the interview card, appeared in the office of the second respondent on the date fixed for the interview and she had performed well in the interview. However, after conducting the interview for the post of Noon Meal Organiser, the further process of the appointing the petitioner in the said post was deferred https://hcservices.ecourts.gov.in/hcservices/
without assigning any reason. Under these circumstances, the present writ petition is filed seeking a direction to appoint the writ petitioner.
4. The appointment can never be claimed as a matter of right. Mere participation in the interview by the writ petitioner will not confer any right. As a matter of fact, cancellation of selection process is a prerogative administrative power of the department and in case of cancellation of the selection, the candidates who participated in the interview, cannot claim any right for appointment. Such being the legal principle, the relief as such sought for in this writ petition cannot be considered.
5. Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs. Sd/- Assistant Registrar(CCC) //True Copy// Sub Assistant Registrar dna To 1.The District Collector, Thiruvannamalai District, Thiruvannamalai.
