In view of the fact that the decree under challenge is one for partition, if the final decree proceedings are allowed to go on, the appeal itself would become infructuous. Hence, there will be an order of stay of passing of final decree alone, the other proceedings shall go on. Accordingly, this petition is allowed and the stay is made absolute till the disposal of the appeal.
