This petition is filed to condone the delay of 145 days in filing the above appeal.

2. The learned counsel for the petitioner submitted that the first respondent remained exparte before the Tribunal and hence, notice to the first respondent may be dispensed with.

3. Heard the learned counsel appearing for the petitioner as well as the second respondent.

4. Being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay is condoned and this petition is ordered on condition that the petitioner/appellant shall forfeit the interest for the delayed period, in the event of this court enhancing the compensation.

5. Registry is directed to number the C.M.A, if it is otherwise in order and the list the same in due course.
