PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to direct the Metropolitan Magistrate (Additional Mahila Court), Egmore, Chennai to furnish a copy of the Compact Disk filed by the respondent police along with the final report in C.C.No.159 of 2017.

O R D E R

This petition has been filed seeking for direction to

the learned Metropolitan Magistrate (Additional Mahila Court), Egmore, Chennai to furnish a copy of the Compact Disk filed by the respondent police along with the final report in C.C.No.159 of 2017. 2.

The learned Additional Public Prosecutor on instructions submitted that the Compact Disk which is relied upon as a document by the prosecution, has already been submitted along with the final report in C.C.No.159 of 2019.

The learned counsel for the petitioner submitted that once the compact disk is submitted as a document before the Court below and the prosecution is relying upon the same, the petitioner is also entitled for a copy of the same and it has to be supplied to him under Section 207 of Cr.PC.

Taking into consideration the facts and circumstances of the case, there shall be a direction to the Court below to supply a copy of the compact disc filed by the prosecution along with the final report, in order to enable the petitioner to defend himself effectively during trial.

This Criminal Original petition is disposed of accordingly.
