PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India to pass a direction to the Principal District Munsif at Gingee to dispose of suit on O.S.No.127 of 2019 within a time frame fixed by this Court. For Petitioner : Mr.V.L.Nehru *****

O R D E R

This Civil Revision Petition is filed seeking direction of the learned Principal District Munsif, Civil Judge (Junior Division), Gingee to dispose of the suit in O.S.No.127 of 2019.

2. The learned counsel for the petitioner submitted that the respondent filed this suit for grant of permanent injunction against the petitioner and he also filed I.A.No.640/2019 for temporary injunction. Interim injunction was granted in I.A.No.640/2019. Taking advantage of the interim injunction granted, the respondent is trying to evict the petitioner from the suit property with the help of the police. Therefore, the present Civil Revision Petition is filed.

3. This Court informs that this suit was filed only in the year 2019 and there are suits much older than this suit pending before the learned Principal District Munsif, Civil Judge (Junior Division), Gingee. Learned counsel for the petitioner restricted his prayer to give direction to the learned Principal District Munsif, Civil Judge (Junior Division), Gingee to dispose I.A.No.640/2019 within a time frame to be stipulated by this Court.

4. In view of the submission made and also that interim injunction is granted, the Court should make endeavour to dispose of the application within 30 days from the date injunction is granted. Learned Principal District Munsif, Civil Judge (Junior Division), Gingee is directed to dispose I.A.No.640/2019

as expeditiously as possible, within a period of 30 days from the date of receipt of a copy of this order. It is also represented that there is I.A.No.649 of 2019 filed for the return of plaint. Learned Principal District Munsif, Civil Judge (Junior Division), Gingee is also directed to dispose of the same expeditiously a possible.
