The application has been filed to condone the delay of 118 days in filing the written statement.

2. It is contended that only because of the confusion, led to the filing of this petition. In fact the written statement has already been filed and based on that this Court framed issues on 13.12.2021 and the matter was to be posted before the Master Court. Now the matter is posted before this Court. PW1 was also partly cross-examined.

3. At this Stage based on the endorsement made in the written statement by the Registry, this application is filed. This Court is of the view that the very endorsement made by the Registry is not in order, since the written statement has already been taken note of by this Court and the issues have been framed. It should be construed that written statement is already filed.
