The petitioner/A1, who was arrested and remanded to judicial custody on 27.09.2023, pursuant to the Non-Bailable Warrant of arrest issued against him in S.C.No.193 of 2018 pending on the file of the learned Principal Subordinate Judge, Vellore, in connection with Crime No.425 of 2015 registered for the offences under Sections 294(b), 506(ii), 392, 394 r/w 397 of IPC, seeks bail.
2. Learned counsel for the petitioner submitted that the petitioner is an accused facing trial in S.C.No.193 of 2018, pending on the file of the learned Principal Subordinate Judge, Vellore. He further submitted that the petitioner has failed to appear before the trial Court, therefore, the trial Court had issued a non-bailable warrant of arrest against the petitioner on 30.08.2022. Pursuant to the same, the petitioner was formally arrested by the respondent on 27.09.2023. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and therefore, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent submitted raised objection stating that, pursuant to the non-bailable warrant of arrest issued by the trial Court against the petitioner, he was formally arrested on 27.09.2023. He further submitted that the petitioner is a habitual offender, against whom 52 previous cases are pending, therefore, if he is released on bail, there is a possibility of him absconding again and will not available for trial. https://www.mhc.tn.gov.in/judis

4. Taking into consideration the facts and circumstances of the case, the submissions made by the learned Government Advocate (Crl.Side) and also considering the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner.
