Prayer : Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus to consider the petitioner's representation dated 30.06.2014 and subsequent representations sent for assigning a land for house at Palappattu Village, Gingee Taluk, Villupuram District, comprised in Natham Survey No.127/181/1 or any other suitable place. For Petitioner :

Mr.R.Thanjan For Respondents :

Mr.R.Vijayakumar Additional Government Pleader

O R D E R

Heard Mr.R.Thanian, learned counsel appearing for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader appearing for the respondents. With the consent of either side the Writ Petition itself is taken up for final disposal at the admission stage.

2.The Petitioner seeks for a direction upon the respondents to assign a land for house at Palappattu Village, Gingee Taluk, https://hcservices.ecourts.gov.in/hcservices/

Villupuram District, comprised in Natham Survey No.127/181/1 or any other suitable place.

3.According to the petitioner, she is a land less poor and she does not have any property and Highways Department are threatening to evict her. Therefore, the petitioner seeks for assignment of land. 4.Admittedly, the land is a government land and it appears that the land is a High ways land. Therefore, there is no right for the petitioner to seek house site patta or assignment and the same cannot be granted, hence this petition is dismissed. However, this will not prevent the petitioner from furnishing a fresh representation for allotment to some other land, which is unobjectionable and if the same is submitted, the authorities concerned are directed to consider the same and pass appropriate orders on merits and in accordance with law.

With the above observation, this petition is dismissed. No costs.
