M.Gopala Krishnan v. C.Rajeshwari
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 10.07.2019
CORAM
THE HONOURABLE MR.JUSTICE T.RAJA Tr.C.M.P.No.518 of 2019 M.Gopala Krishnan ...
Petitioner -vsC.Rajeshwari ...
Respondent Transfer Civil Miscellaneous Petition filed under Section 24 of the Code of Civil Procedure to withdraw the H.M.O.P.No.206 of 2018 on the file of the Family Court at Namakkal and transfer the same to the file of the Family Court at Chennai. For Petitioner ::
Mrs.P.Lakshmi Devi
ORDER
This transfer civil miscellaneous petition has been filed by the husband of Mrs.C.Rajeshwari, the respondent herein seeking transfer of the pending H.M.O.P.No.206 of 2018 from the Family Court, Namakkal to the Family Court at Chennai, on the ground that the petitioner, who is working in Singapore has been facing threat at the hands of the respondent-wife and her family members. When the petitioner alleges threat from the respondent-wife, nowhere the petitioner has given any complaint against such threat to any authority. Therefore, taking note of the fact that the transfer of the case to any place is not going to be a matter, as the petitioner has been working in Singapore and there is also an office at Chennai, on the lame excuse placed before this Court without being supported with any reason or good cause for the alleged threat, this Court is not inclined to entertain the transfer civil miscellaneous petition. Accordingly, the transfer civil miscellaneous petition is dismissed.
