ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 87, 127 (2) of BNS, 2023 and 9, 10 of the Prohibition of Child Marriage Act, 2006 and Section 5 (l), 17 r/w Section 6 of the Protection of Children from Sexual Offences Act, 2012, in Crime No.31 of 2025, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and the victim girl are relatives. The petitioner had married the victim girl who is aged about 17 years. Thereafter he had committed penetrative sexual assault on her. Hence the case. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the custodial interrogation of the petitioner is not required and sought for anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor reiterated the prosecution case and opposed for grant of anticipatory bail to the petitioner. 5.Head the learned counsels on either side and perused the records. 6.On perusal of the records and the statement recorded under Section 164 Cr.P.

C, reveals that the minor victim girl was married to the petitioner who is aged about 37 years. Thereafter, the petitioner also committed penetrative sexual assault on the victim girl. Therefore, the petitioner had committed very serious and heinous offence against the minor victim girl and the custodial interrogation of the petitioner is very much required. Hence, this Court is not inclined to grant bail to the petitioner.
