JUDGMENT

(Judgment of the Court was made by D.Krishnakumar, J.) The learned counsel for the appellant submitted that the appellant has filed W.P.No.17257 of 2019 for enhancement of the retirement age till 60 years and the Writ Court has declined to grant interim relief in the said writ petition, against which the present writ appeal has been filed. By virtue of the interim order granted in the present writ appeal, the appellant was continuing in the department till he attained the age of superannuation and in the meantime, he was terminated from service and the said order was put to challenge in a separate writ petition. While that being so, nothing survives for further adjudication in the present writ appeal.

2. The learned counsel for the respondents also fairly admitted the aforesaid fact.

3. In view of the above, no further orders are necessary in the present writ appeal and accordingly, the writ appeal stands dismissed as infructuous. It is open to the parties to seek appropriate remedy in the pending writ

petition. No costs. Consequently, connected miscellaneous petition is also dismissed.
