The learned Counsel for the Petitioner submits that the petition has been filed to condone the delay of 49 days in filing the Appeal against the order and decree dated 06.01.2024 in EIOP.No.9 of 2011 on the file of the Employees Insurance Court (Principal Labour Court), Chennai.
2. Mr.G.Bharadwaj, learned Standing Counsel for ESI undertakes to file Vakalat for the Respondent and has no objection in allowing the petition provided that the interest for the period of delay of 49 days is waived.
3. Accordingly, this Petition is allowed on condition that the Petitioner is not entitled to claim interest for the period of delay of 49 days and the delay of 49 days is condoned.
4. Registry is directed to number the Appeal if it is otherwise in order.
