Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the 1st respondent to give license to run a Bunk shop near Nungambakkam lake area 4th Cross Street, 3rd Street Corner place, Chennai pursuant to the representation dated 15.09.2016. ORDER
The petitioner has come up with this petition for issuance of a mandamus to direct the 1st respondent to give license to run a Bunk shop near Nungambakkam lake area 4th Cross Street, 3rd Street Corner place, Chennai pursuant to the representation dated 15.09.2016.
2. The case of the petitioner is that he is a handicapped person and belongs to a poor family. In order to eke out his livelihood, the petitioner sent a representation to the Corporation of Chennai seeking for licence to run a bunk shop in the said place. Since the said representation is not yet considered, the present writ petition.
3. Heard the learned counsel for the petitioner, learned standing counsel for the Corporation / respondents 1 & 2 and the learned Special Government Pleader for the 4th respondent.
4. The learned standing counsel for the Corporation / respondents 1 & 2 submitted that the petitioner is not running bunk shop as on date and his application would be considered in accordance with law.
5. In the light of the above facts and submissions of the learned counsels for both sides, this Court, without going into the merits of the case, directs the respondents to consider the representation of the petitioner dated 15.09.2016 and pass orders on merits and in accordance with law, after providing opportunity to the petitioner, within a period of twelve weeks from the date of receipt of copy of this order.
6. With the above observation and directions, the writ petition is disposed of. No costs.
