This case is taken up for settlement before the National Lok Adalat. Mr.P.Sankaranarayanan, learned counsel for the Appellant and Mr.T.G.Balachandran, learned counsel for the first Respondent are present before this Court.

TERMS OF SETTLEMENT This Civil Miscellaneous Appeal had been filed by the Appellant/Insurance Company aggrieved by the award of a sum of

Rs.3,85,900/- (Rupees Three Lakhs Eighty Five Thousand and Nine Hundred Only) as compensation for the injuries suffered by the first Respondent/Claimant along with interest at the rate of 7.5% per annum. 2.The Appellant/Insurance Company entered into an agreement whereby the first Respondent/Claimant agreed to receive a sum of Rs.2,50,000/- (Rupees Two Lakhs and Fifty Thousand Only) with interest at the rate of 7.5% per annum from the date of claim petition.

3. It was agreed that the first Respondent/Claimant is entitled to receive a sum of Rs.2,50,000/- (Rupees Two Lakhs and Fifty Thousand Only) with interest at the rate of 7.5% per annum from the date of claim petition.

4. The Appellant/Insurance Company had already deposited 50% of the award amount, hence, the Appellant/Insurance Company is directed to deposit the balance amount agreed now with interest at the rate of 7.5% per annum from the date of Claim Petition, within a period of eight weeks from today.

5. On such deposit, the first respondent/claimant is entitled to withdraw the entire amount. Consequently, connected miscellaneous petition, if any, is closed.
