BY ITS, [ RESPONDENT ] THE INSPECTOR OF POLICE, ALL WOMEN POLICE STATION, GINGEE VILLUPURAM, DISTRICT CR.NO.21 OF 2011.
Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Appeal No.148/2018 on the file of the High Court, the High Court will be pleased to suspend the sentence imposed on the petitioner by the Judgment dated 22.02.2018 made in S.C.No.83 of 2013 on the file of the Court of the Sessions Judge, Magalir neethi Mandram (Fast Track Mahila Court), Villupuram and enlarge the petitioner on bail pending disposal of the above Criminal Appeal No.148 of 2018.
Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl. Appeal No.148/2018 on the file of the High Court and upon hearing the arguments of MR. K.GOVIGANESAN Advocate for the petitioner and of MR.T.P.SAVITHA Government Advocate on behalf of the Respondent the court made the following order:- Petitioner faced trial in S.C.No.83 of 2013 on the file of Sessions Judge, Mahalir Neethi Mandram (Fast Track Mahila Court), Villupuram. Under judgment dated 22.02.2018, trial Court convicted them and sentenced as follows:
Section of law Sentence 417 IPC 1 year R.I. and also imposed with fine of Rs.1,00,000/- i/d 6 months S.I.
Hence, petitioner seek suspension of sentence.
2. Mrs.T.P.Savitha, learned Government Advocate, takes notice for respondent.
3. Taking into consideration the submissions of learned counsel for petitioner and that the revision is not likely to be taken up for final hearing in the near future, this Court is of the view that petitioner herein may be granted the relief of suspension of sentence.
4. Accordingly, the substantive sentence of imprisonment alone is suspended and petitioner is directed to be enlarged on bail on condition that each of the petitioners shall execute a bond in a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of learned Judicial Magistrate No.II, Villupuram and on further condition that petitioner shall appear before the said Court on the first working day of every month at 10.30 a.m. pending revision.
