PRAYER : Writ Petition filed Article 226 of the Constitution of India, Writ of Mandamus, to direct the first and second respondents to consider the representations of the petitioner dated 17.05.2011 and 17.08.2021 to remove the name of the petitioner from the History Sheet maintained by the third respondent Police Station.

O R D E R

This petition has been filed to direct the first and second respondents to consider the representations of the petitioner dated 17.05.2011 and 17.08.2021 and remove the name of the petitioner from the History Sheet maintained by the third respondent Police Station.

2. The petitioner sent a representation on 17.08.2021 to remove his name from the History Sheeter list. Since no action has been taken, the present petition.

3. The petitioner is a business man and he is residing in Chennai for more than 50 years. He is a Tax Payer and his wife is a fashion designer. The case of the petitioner is that he was classified as a History Sheeter in the year 2002 though he was acquitted form all the cases. The cases filed against him are civil in nature, however the criminal complaints were filed only to grab his property. Though the petitioner has made various representations, the same has not been considered in an objective manner and remove his name from the History Sheeter list.

4. The learned Additional Public Prosecutor has submitted that the representation of the petitioner has been received by the Commissioner of Police and the Deputy Commissioner of Police, Kilpauk, and shall consider and pass orders on the representation of the petitioner.

5. In view of the above, the Deputy Commissioner of Police, Kilpauk shall consider the representation of the petitioner and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.

6. With the above directions, this Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
