This Writ Petition is filed under Article 226 of the Constitution of India, seeking to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned objection vide OBJ/1049089604/25 dated 05.05.2025 passed by the third respondent and to quash the same as illegal, arbitrary and non-est and consequently to direct the respondents 1 to 3 to issue passport to the petitioner within a stipulated time.

ORDER

This Writ Petition has been filed seeking to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned order dated 05.05.2025 passed in OBJ/1049089604/25 by the third respondent and to quash the same as illegal, arbitrary and non-est and consequently to direct the respondents 1 to 3 to issue passport to the petitioner within a stipulated time.

2. Heard the learned counsel appearing for the petitioner, the learned Central Government Standing Counsel appearing for the respondents 1 to 3 and the learned Additional Public Prosecutor appearing for the respondents 4 and 5 and perused the materials available on record. 3.The learned counsel for the petitioner submitted that with regard to the dispute between the parties, two FIR's were registered by the respondent-Police and final reports have been filed before the concerned Court and the same were taken on file in C.C.Nos.226 and 227 of 2023. He further submitted that this Court had already stayed the proceedings in C.C.No.226 of 2023, vide order dated 02.02.2024 in Crl.O.P.No.1848 of 2024. Hence, the petitioner filed an 3/6

application seeking renewal of passport before the third respondent. The third respondent objected the same vide impugned order dated 05.05.2025. Aggrieved by the same, the petitioner has filed this writ petition.

4. Learned Counsel appearing for the respondents submitted that since the proceedings in CC has been stayed by this Court, now, the third respondent will consider and proceed with the petitioner's application in accordance with law.

5. The abovesaid submission made by the learned counsel for the respondents is recorded. The third respondent is directed to consider the petitioner's application and issue a passport to the petitioner as per law, within a period of two months from the date of receipt of a copy of this order.

6. With the abovesaid direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 09-09-2025 mfa Index:Yes/No Speaking/Non-speaking order Internet:Yes 4/6
