The petitioner suffered an adverse order on ex parte basis at the hands of the respondent. Challenging the same, the present writ petition came to be filed.
2. Today, when the matter was taken up, the petitioner undertook to remit 25% of the disputed tax amount.
3. Recording this undertaking, the order impugned in this writ petition is set aside and the matter is remitted back to the respondent for fresh consideration. The petitioner shall appear before the respondent on 30.06.2025 at 04.00pm. Before this date, the amount undertaken to be remitted shall be remitted. If the petitioner fails to make such remittance, the benefit of this order will not be available to the petitioner. The impugned order is set aside only on account of the undertaking given by the petitioner.
The writ petition is allowed accordingly. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed. 2/4
