Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the 1st respondent to consider and pass orders on merits by disposing the written representation made by the petitioner on 08.06.2018.

ORDER

[Order of the Court was made by M.SATHYANARAYANAN, J.,] By consent, the writ petition is taken up for final disposal. Mr. R.Udhaya Kumar, learned Additional Government Pleader accepts notice on behalf of respondents.

2. The petitioner who claims to be a resident of Kandipalayam, Vadakaraiyathur Village, Paramathivelur Taluk, Namakkal District, came forward to file this writ petition styled as Public Interest Litigation alleging among other things that in his Village, people belongs to all caste and community without any difference of opinion are happily living together and in the temple located in the said place, the deity viz., Pakavathi Amman, Ongali Amman and Vinayagar, are there and however, the people belonging to particular community have removed the Vinayagar Idol and want to put up a new religious structure, which will lead to law and order problem. In this regard, the petitioner submitted a representation dated 08.06.2018 restraining the people belonging to particular community to put up a seperate religious structure and despite receipt and acknowledgement, no orders have been passed.

3. Mr.C.Prakasam, learned counsel appearing for the petitioner on

instructions would submit that since the religious structure has been planned to be put up without any permission or whatsoever and deity has been removed and the same has been kept in the office of the 3rd respondent, the District Revenue Officer has also convened a peace committee meeting.

4. This Court has considered the rival submissions and also perused the materials placed before it.

5. In the light of the fact that the presiding deity Vinayagar has been removed and that particularly District Revenue Officer has also convened a peace committee meeting to solve or iron out the difference to restore the peace and prevent the law and order problem, this Court is of the considered view that no further orders are required in this writ petition.
