This petition is filed to set aside the order dated 02.07.2010 dismissing the appeal in respect of first respondent.

2. Heard the learned counsel appearing for the petitioner as well as second respondent.

3. In view of the order dated 04.11.2020 made in CMP No.1018 of 2012 in CMA No.3480 of 2004, this petition is ordered and the order dismissing the appeal against the first respondent is restored.

4. Post the appeal on 10.11.2020.
