PRAYER: Writ Petition filed under Article 226 of Constitution of India, seeking Writ of Mandamus directing the respondents to consider the representation dated 31.05.2023 and to de-seal the premises in No.1A, Velammal Vidyalaya School Main Road, Karumariamman Nagar, Ayanambakkam Village, Maduravoyal Taluk, Thiruvallur District, for upkeep of the property and to ensure protection of the petitioner's rights to the property. ORDER

This writ petition has been filed for a direction to the respondents to act upon the representation made by the petitioner and to de-seal the premises within the time frame fixed by this Court.

2.The petitioner is the landlord of the subject premises. The petitioner had leased out the property to one Rajasekar. This person was doing a business under the name and style of M/s.Aarudra Gold Trading Pvt. Ltd., Page No.2/6

Due to the non payment of the deposits, an F.I.R. came to be registered and during the course of investigation, the 3rd respondent sealed the premises. 3.The petitioner made a representation on 01.12.2022 and thereafter yet another representation on 31.05.2023 and requested the 3rd respondent to de-seal the property. Since the same was not acted upon, the present writ petition has been filed before this Court.

4.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. 5.The learned Additional Public Prosecutor submitted that the investigation has been completed and final report has also been filed before the TNPID Court, Chennai and the same has been taken on file in C.C.No.9 of 6.In the light of the above development, no useful purpose will be served in keeping the property under lock and seal. The 3rd respondent is directed to de-seal the premises and hand over possession of the property to the Page No.3/6

petitioner. This process shall be completed within a period of four (4) weeks from today.

7.This writ petition is disposed of with the above directions. No costs.
