Respondent(s) PRAYER : Writ Petition filed under Article 226 of Constitution of India praying (i) to direct the 4th respondent to cease and desist from recovering any kind of dues including Pre-EMI and EMI payments from the Petitioner in respect of the loan amounts disbursed by them to 3rd respondent until repayment of the entire sum of Rs.85,46,710.79/-by the 3rd respondent to the 4th respondent shown as over-due under loan account no.
5527636123 held with the 4th respondent; (ii) to direct the 4th respondent not to initiate or continue any sort of precipitative or coercive action including action under SARFAESI Act, 2002 and Negotiable Instruments Act, 1881or under any law against the petitioner to recover of any amounts; (iii) to direct the 3rd respondent to pay the pre-EMI /EMI to 4th respondent on behalf of the petitioner until repayment of the entire sums due in the loan account no. 5527636123 held with the 4th respondent; and (.iv) to direct 1st and 2nd respondent to restore the CIBIL score of the Petitioner as it stood prior to the default on the pre-EMIs / EMIs by 3rd Respondent, and pass orders.

ORDER
