This petition has been filed seeking to set aside the order of dismissal against the first respondent in the above CMA and necessary.

2. The affidavit filed in support of this petition has been perused and on being satisfied with reasons stated therein, this Court is inclined to set aside the order of dismissal as against the first respondent in the above CMA.

3. Accordingly this CMA is restored as against the first respondent and the petition is allowed.
