ORDER

Heard Mr.T.Arockiadoss, learned counsel for the petitioner and Mrs.P.Rajalakshmi, learned Government Advocate accepting notice on behalf of the respondent and with their consent, the main writ petition is taken up for disposal.

2. The petitioner seeks for a direction upon the respondent to consider his representation dated 20.02.2015.

3. The petitioner would state that he is the owner of the property in Survey No.225/35 part New Survey No.282/25, patta No.191, to an extent of 390 sq.ft. and that there is a old building in the said property, which is in dilapidated condition. The petitioner proposes to demolish the building and reconstruct the same and has obtained appropriate permission from the Corporation, Chennai. It is the case of the petitioner that his elder brother Hariharan has taken the property and threatened him as well as his mentally challenged son. In this regard, a complaint is said to have been given to the respondent police.

4. Sofar as the demolition of the property is concerned, the respondent police cannot take any action, since, it appears that the petitioner's brother is also claiming right over the property. However, if a complaint has been made with regard to threat made out to the life of the petitioner as well as the mentally challenged son, then the respondent police shall enquire into the complaint and proceed in accordance with law.

The writ petition is disposed of with the above observation. No costs.
