Heard both sides.

2. The petitioner seeks temporary electricity connection for constructing a house. The petitioner's request was not accepted by the second respondent for the reason that she has not obtained No Objection Certificate from the jurisdictional Tahsildar.

3. The requirement of obtaining No Objection Certificate from the Tahsildar will arise only if the petitioner is in occupation of poramboke property. In this case, as on date, patta is standing in the name of the petitioner's husband. Since the land in question is the patta land, the 2/4

question of obtaiing No Objection Certificate from the Tahsildar does not arise at all.

4. In this view of the matter, the impugned communication dated 05.05.2025 is set aide. The learned Standing counsel for TANGEDCO states that if the application is rejected, the fee remitted by the petitioner's husband will be refunded. If the fees is not refunded so far, it shall be refunded as expeditiously as possible. The petitioner shall file a fresh application and comply with all other usual formalities. Thereafter, the second respondent shall provide temporary electricity connection for the petitioner without any delay.

The writ petition is allowed accordingly. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed. 16.05.2025 Speaking order / Non-speaking order Index : Yes / No : Yes / No gpa 3/4
