Prayer: This petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus directing the first respondent to consider petitioner's representation dated 03.05.2024 and take proper action within a stipulated time and pass orders. ORDER
This petition is filed to seeking a direction directing the first respondent to consider petitioner's representation dated 03.05.2024 and pass orders.
2. By consent of both the parties, this writ petition is taken up for disposal at the admission stage itself.
3.The facts of the case is that the petitioner executed a settlement deed in favour of his son/second respondent vide Doc.No.9287/2016 dated 12.04.2016, DocNo.4794/2016 dated 12.04.2016, Doc.No.5291/2016 dated 12.04.2016 and doc.No.14437/2020 dated 19.12.2020 registered in Avinashi Sub-Registrar Office, Tiruppur District. After obtaining the properties the petitioner was not taken care by his son/second respondent and now he is suffering from age-related ailments. Due to which the petitioner made a complaint before the first respondent under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 to cancel the settlement deed executed to his 2/5
son/second respondent. The grievance of the petitioner is that there is no progress in the said complaint. Hence, this petition.
4. The learned counsel appearing for the petitioner submitted that the petitioner is a senior citizen and suffering from age-related ailments. He further submitted that his son who is the beneficiary to the properties and not taking care of the petitioner. Hence, prays to allow this petition.
5. The learned Special Government Pleader appearing for the First respondent submitted that they will prioritize the case of the petitioner as the petitioner is a senior citizen and will take action in the manner known to law as early as possible.
6. For the foregoing reasons, this Court without expressing any opinion on the merits of the case directs the first respondent to consider the petitioner's complaint dated 03.05.2024 and pass orders within a period of eight weeks from the date of receipt of a copy of this order. 3/5
7. With the aforesaid direction, this writ petition is disposed of. No order as to costs.
