Today, when the matter is taken up for consideration, there is no representation for the appellant to proceed the case. This shows the non-willingness attitude of the appellant in the case. Under these circumstances, considering the pendency of the appeal for a long period of 17 years, this Court has left with no other option except to dismiss the appeal. In the result, these second appeal is dismissed for nonprosecution. No costs. Consequently, connected miscellaneous petition is closed.
