confirming the report of the third respondent, dated 25.01.2023 and to quash the same with consequential directions to the second respondent to release the terminal benefits as well as the amount of Rs.4,88,019/- recovered from the petitioner towards the pecuniary loss said to have been resulted on account of his alleged lapses.

ORDER

This Writ Petition is filed seeking to quash the proceedings of the second respondent, dated 30.06.2023 confirming the report of the third respondent, dated 25.01.2023 with consequential directions to the second respondent to release the terminal benefits as well as the amount of Rs.4,88,019/- recovered from the petitioner towards the pecuniary loss said to have been resulted on account of his alleged lapses.

2. By the order, dated 30.06.2023, the respondents awarded a penalty of recovery of pecuniary loss of Rs.4,88,019/-. As against the said punishment, the petitioner already filed an appeal on 29.08.2023 before the first respondent/appellate authority. It is seen that the same is yet to be disposed of.

3. Mrs.P.Veena Suresh, learned Counsel takes notice for the respondents.

In the above circumstances, this Writ Petition is disposed of by directing the first respondent/appellate authority to consider the appeal filed by the petitioner, dated 29.08.2023 after affording an opportunity of personal hearing to the petitioner and dispose of the appeal in accordance with law within six weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
